Question:
How can I pursue a wrongful death in a truck accident?
Answer: I was recently retained by a client. His sister, unfortunately, died when her vehicle was struck by a truck for a plumbing company. The brother said to me, my sister wasn’t married. She didn’t have any children, but she was the only sister I had. Is there anything we can do about it?
If you’re watching this video, you might be in that situation, too. You may be somebody who’s asking the question, is there justice for my brother, my sister, my parent, my relative, my son or my daughter who was killed because of a negligent truck driver? The answer is yes; there is justice. Typically, it’s a spouse or a child who will bring the action as the personal representative for the deceased family member, but it can also be a parent, a brother, or a sister, or any relative who wants to pursue justice on behalf of their loved one that they lost.
The goal, of course, is to find any survivor of this loss and make sure that they have compensation. Now, Florida law restricts who qualifies as a survivor, but every life counts in this state. There’s value in life whether it’s how that person contributed to other peoples’ lives, or whether they were generating an income for their estate, or even if they just had a bond with somebody. We’re going to find the best way to get full compensation for the loss of that life.
It’s not about retribution; it’s about accountability. We all understand that the roads are dangerous. We have a duty to use care for the other people on our roads. Florida law recognizes that if we breach that duty, we have a responsibility to those who have been lost or injured.
My job and my passion is to pursue accountability for those who have been lost. It can be a family member; it can be a husband or a wife. We can sort through it all. We can find the best way to get full compensation in these situations of great tragedy.
