Question:

What happens to my debt when I file chapter 13 bankruptcy?

Answer:

Unsecured Debt in Chapter 13 BankruptcyOnce in a while a Chapter 13 client will ask whether credit card debt is part of the payment plan. The answer is simply that the debtor makes a payment once a month to a bankruptcy trustee who is assigned to the case. The terms of the plan determine how that money is divided up among the creditors. Every creditor in a bankruptcy case is entitled to file a claim, including a credit card lender.

The best suggestion I can make is that if you, a friend, or a family member has questions about Chapter 13, please give us a call. I’ve been representing Chapter 13 clients throughout the state of Florida for about 30 years. We provide a free consultation, and we are happy to help.
