What happens to my debt when I file chapter 13 bankruptcy?
Answer: Once in a while a Chapter 13 client will ask whether credit card debt is part of the payment plan. The answer is simply that the debtor makes a payment once a month to a bankruptcy trustee who is assigned to the case. The terms of the plan determine how that money is divided up among the creditors. Every creditor in a bankruptcy case is entitled to file a claim, including a credit card lender.
