Settling a Personal Injury Case Out of Court

I had a client just yesterday ask me the question, is it possible to settle a personal injury case in Florida without going to court. The answer is, yes, it’s certainly possible. In fact, we attempt to settle every case out of court when the other side presents a reasonable opportunity for settlement. When we don’t get enough good faith on the other side, of course, then we go to court.

We exhaust all of our pre-litigation efforts to resolve a dispute. I think that’s essential for any good attorney. Then if we don’t get a reasonable offer of settlement from the other side, then we absolutely file a lawsuit and proceed to a jury trial.
