Question:

What are the restrictions for filing chapter 7 bankruptcy?

Answer:

Chapter 7 Filing RestrictionsOnce in a while, I’ll get a question from a client about who’s not eligible for a discharge in a bankruptcy case in Florida. The answer is a little bit complicated but, suffice it to say, generally people who are honest and down on their luck are eligible for bankruptcy. There is a time period restriction – if you’ve filed a bankruptcy case and you’ve been discharged, you can’t file another Chapter 7 bankruptcy case within eight years of the first filing, and there’s a similar time restriction in Chapter 13.

For your case, specific inquiry, I can’t do better than to just encourage you to give us a call. We’ll sit down, go through it with you carefully, and see whether bankruptcy is right for you. We’ve been representing clients for the last 30 years throughout the state of Florida, and we are happy to help.
