What are the restrictions for filing chapter 7 bankruptcy?
Answer: Once in a while, I’ll get a question from a client about who’s not eligible for a discharge in a bankruptcy case in Florida. The answer is a little bit complicated but, suffice it to say, generally people who are honest and down on their luck are eligible for bankruptcy. There is a time period restriction – if you’ve filed a bankruptcy case and you’ve been discharged, you can’t file another Chapter 7 bankruptcy case within eight years of the first filing, and there’s a similar time restriction in Chapter 13.
