Question:

Are any of my assets protected in chapter 13 bankruptcy?

Answer:

Assets Protected in Chapter 13 BankruptcyWhenever I meet with a client, we always talk about what assets are affected in the bankruptcy. When we talk about assets, we consider exemptions. What assets are, under the law, protected from creditors in your bankruptcy case? The best example that I can give here is that, in Florida, the home is typically protected. A person can file bankruptcy and keep his or her house, just as long as they stay current on their mortgage.

The best recommendation that I can make is if you, a friend, family member, or a loved one has questions about Chapter 13 and how that will implicate assets, please give us a call. I’ve been representing Chapter 13 clients for about 30 years throughout the state of Florida. We provide a free consultation, and we are happy to help.
