Is it a good idea to call the police to a car accident scene?

Commonly Asked Car Accident QuestionsA good friend of mine gave me a call just yesterday. He was involved in a car accident. He was calling me right there from the scene. He was asking me whether it was a good idea to call the police to investigate the scene. When I get these kinds of calls, my answer is always yes.

Number One, police don’t always show up at the scene, even when you do call. Number Two, it’s important for a person involved in a motor vehicle accident to be able later to prove the date, time, and place that the accident occurred. When a person’s first involved in an accident, they don’t know whether they are actually injured because the adrenaline is flowing. They may seem okay or they may be blocking out the pain due to all the other exigencies that the accident presents.

What should I do if the other party’s insurance denies liability?

When I’m asked what clients do if the other party’s insurance company denies liability, what I say first and foremost is that we need to investigate to find the basis on which they are denying liability. An insurance company under Florida law has a duty of good faith and fair dealing toward their own insured. They’re not allowed to deny liability under Florida law unless they have a good reason or a valid basis to deny the liability because, if they deny liability without a good reason, and their own insured gets sued by someone who was injured in the accident and proves that their insured was at fault, that insurance company now can be held liable not only for the policy limits that they insured the insured for, but also be liable for more than those policy limits under what we call bad faith insurance practices.

If liability is denied by the other side and you believe that it’s denied without a basis or it’s being denied wrongfully because the facts do not support such a denial of the liability, come talk to us here at Perenich Law Injury Attorneys. What should I do if I was injured in a car accident?

I’m often asked, “What should I do if I’ve been injured in a car accident here in Florida?” First and foremost, get medical treatment. After the crash, you may be hyped up on the adrenaline. You may not even feel all of the injuries that you’ve taken on. Don’t automatically turn away the ambulance. They call paramedics and the EMT people to the accident scene because car accidents are dangerous and they involve typically very serious injuries, even low-impact/low-speed collisions.
The next thing to do is to call an experienced trial counsel to help you navigate your case. A good attorney will understand that evidence can grow stale. What we do is we send an investigator out to the scene to take photographs of both vehicles.

If you’ve been involved in the accident and you have your cell phone, take photographs. Take photographs of all areas of your vehicle that were involved. Same with the other car, including the license plate. Get names and take photographs of the driver licenses of any witnesses that have contact information. Those are the critical things that a person should do when he or she has been involved in a motor vehicle accident here in Florida.
