Unless a claimant can prove to a jury that she or he has suffered (a) significant and permanent loss of an important bodily function, (b) permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement, (c) significant and permanent scarring or disfigurement or (d) death, the jury will award a $0.00 verdict.The question of damages also comes up frequently in the context of medical malpractice claims.
