1. How to File Chapter 7 Bankruptcy

Once in a while I’ll get the question from a client, “How do I file a Chapter 7 bankruptcy?” The question almost suggests that it’s up to the client to file the case. One of the worst things that a person can do is to file their own Chapter 7 bankruptcy case. The laws are very complicated, and a person can make a bad situation considerably worse by representing themselves.

2. Chapter 7 Bankruptcy Timeline

Occasionally, a client will ask how long his or her bankruptcy case will take. The answer is it’s about a hundred days from the day we file, until the day the court enters a discharge. A discharge is a document signed by a federal bankruptcy judge that says that the debts are wiped out and no longer enforceable. It’s about a hundred days in a Chapter 7, from the day we file until the court enters a discharge.

Every state has different laws about which assets are exempt and which are not. Typically, here in Florida, a person’s home is 100% exempt. They’re also entitled to a certain amount of equity in a motor vehicle or a value of personal items that they may own.
