Whenever I meet with a client, we always consider what debts are dischargeable. In a Chapter 13, typically most debt is dischargeable but certain debts are not, such as student loans, debt to the IRS, or alimony or child support. Those are examples of debt that may not be dischargeable, and even those require careful consideration and analysis. The point of any bankruptcy case for an individual is to discharge debt and put the debtor back on track. Bankruptcy is a remedy for an honest person who’s down on their luck.
